On June 27, 2024, the U.S. Supreme Court rendered its decision on a petition by the Trustee regarding the case of Purdue Pharma L.P.. In a 5-4 decision, the Court reversed the Second Circuit’s Purdue decision and declined an invitation to anoint chapter 11 as the remedy for deficiencies in the state and federal tort systems. Even before the decision, the case had already generated a mountain of commentary in the form of amicus briefs, petitions and other related background material.
